A judge wants to see the police auditor's report involving an officer involved shooting from 2009.
It’s for a wrongful death lawsuit filed against the Fresno Police Department.
In court Thursday, the judge requested the report for the 2009 death of Steven Vargas, who was high on PCP when he was shot and killed by Fresno police officers.
A lawyer for the family believes the auditor's report could help his case.
The family’s attorney, Arturo Gonzalez said, “It could be devastating. I mean, it depends on what it says, obviously. But, you know, our case relies in part on the face that these investigations are not taken seriously, that they take so long, and the officers are not disciplined.”
The judge wants to see the unedited report, written by former Fresno police auditor, Eddie Aubrey.
The city maintains the officer thought the suspect had a gun and used reasonable force under the circumstances.
