Fresno Child Discovers Porn on Refurbished T-Mobile Cell Phone

A Fresno mother is outraged, after her 11 year old daughter was exposed to explicit photos and she's blaming T-Mobile for the mistake.

Anna Rubio says when her eleven year old daughter stumbled across 25 disturbing images of pornography on her new cell phone, the girl  began crying and screaming.

Anna Rubio says, "These aren't things that you let your child see.  You try to keep them as little as you can for as long as you can with Barbies and butterflies and cartoons."

Rubio says it happened Monday.  T-Mobile mailed the family a refurbished phone, to replace one that had stopped working.  When the young girl clicked on the photo gallery, the porn popped up.

"I'm livid.  I can't believe a company that is so big would let me down so easily," says Rubio.

Rubio called T-Mobile right away.  She says the woman she spoke with was apologetic and guaranteed it would never happen again.  She then apparently went on to tell Rubio it would take 72 hours for the company to investigate and decide how to fix the problem.

Rubio says, "My daughter has to walk to school.  She needs to have a phone in case she has to call 911.  My daughter needs a phone and now she's going to have to go without that until (they) decide to call me back? Instantly, they should have sent me a new phone."

Rubio also claims the T-Mobile representative threw the blame back, asking the mom why she hadn't checked the phone first before giving it to her daughter.

In a statement Wednesday, the company said, "T-Mobile takes this very seriously and we will be investigating this carefully. Our refurbished phones are subject to a content wiping process managed by a third party partner, and we will be looking into this particular situation to determine what may have happened."
