A convicted rapist who had been on the run is in the Fresno Co. Jail along with his family members who are accused of helping him flee the country.
Law enforcement caught 20-year old Spencer Scarber in Mexico. The Squaw Valley man was on trial in December. While out on bail he fled the area.
The big break in this case came on Thursday when Mexican immigration officials took Spencer Scarber into custody in Acapulco for not having proper paperwork. Once they discovered who he was, they contacted Fresno County Sheriff's deputies.
“I'm very grateful that Spencer Scarber is back in custody and will soon be sentenced to do his time for his crimes,” said Fresno Co. Sheriff Margaret Mims.
Spencer Scarber returned to the valley with bleached hair and facial hair. A dramatically different appearance than the clean cut look he sported when he disappeared.
“Scarber's father Kyle reported him missing and possibly kidnapped,” said Sheriff Mims.
Investigators have now arrested Kyle Scarber, an assistant chief with the California Highway Patrol, for lying to protect his son.
“It is always unfortunate whenever we have to criminally investigate a law enforcement officer, but investigate we must,” said Sheriff Mims.
Spencer's sister, Crystal Reynoso, was arrested on suspicions of helping him escape as was their mom, Gail Scarber who allegedly had fake documents on her.
“The documents she possessed were a false birth certificate and passport intended for Spencer,” said Sheriff Mims.
“We’re extremely happy he's back in custody,” said Barry Pearlstein of Lucky Bail Bonds.
Barry Pearlstein of Lucky Bail Bonds put up the money to get Scarber out of jail. Once he fled, it was Pearlstein’s responsibility to return him to court in six months.
“And if we didn't do so we were on the hook for $855,000,” said Pearlstein.
Pearlstein will no longer have to deal with Spencer Scarber because due to his convictions of rape and robbery he is no longer eligible for bail.
Scarber's parents and sister may be allowed to bail out of jail, but that will be up to a judge to decide. Meanwhile, C.H.P. is investigating Kyle Scarber’s involvement and says appropriate action will be taken.
