Gunfire Outside Bulldog Stadium

As Fresno State was playing it's final home game against San Jose State inside Bulldog Stadium, Fresno Police officers were searching surrounding streets for evidence after someone fired more than a dozen shots into the air. Around 5:30 Saturday evening, investigators found bullet casings at three different intersections, all on the perimeter of the stadium.

Luckily no one was hurt, but the potential was there as a game was underway at the time.

"We don't believe anyone was targeted or anyone was in any kind of danger during the incident. At this time we are looking for a silver two door vehicle that possibly has large chrome rims on it," said Lt. Jon Papaleo of Fresno Police.

Jesse Chavez is a parking attendant who was just a short ways away from the car when shots rang out of it on Millbrook Ave.

"I didn't want to get up and run, so I just looked over and just tucked myself. It was pretty scary," said Jesse Chavez.

"It's nuts, ludicrous," said Nick Dvorak.

Dvorak has been coming to games for 35 years.

"There may only be 15,000 people in that stadium, but it's a pretty good target if you're shooting up in the air. That's scary," said Dvorak.

Almost all fans were oblivious to the shootings. However, those parked in the sorority and fraternity lots found they could not get to their vehicles as officer sealed off the area to collect bullet casings.

Tom Wollenman was one of those inconvenienced. What's worse is he couldn't get back inside the stadium either.

"There's no in and out privileges, so we're here doing this interview," said Tom Wollenman.

This happens on a weekend where police have stepped up patrols putting 50 additional officers on the streets. It's in response to the Thanksgiving night shooting of 9-year old Davione Saint Mary who remains hospitalized.

"We're very fortunate we do have the extra bodies right now, so we do have the resources available to deploy down here," said Lt. Papaleo.


Grease Fire Burns 3 People

Three people are injured while putting out a grease fire.

The Fresno Fire Department responded to
5466 N. Figarden Dr.
Saturday afternoon for reports of an apartment fire. The fire was reported at , when Fresno Fire arrived they found an extinguished kitchen grease fire. The damages to the apartment and contents were minimal. 

2 adults and 1 child were injured while they were trying to put out the fire. All 3 residents received non-life threatening burns. They were transported to the hospital by ambulance and treated for their burns.  

Two Killed in Suspected DUI Crash

Clovis Police are investigating a suspected drunk driving crash that killed a man and a woman early Sunday morning.  It happened at near the intersection of Minnewawa and Barstow.

Officers arrested Larry Garcia.  The 29-year old from Clovis was allegedly drunk when his pickup collided with a car carrying two people.

According to the Fresno County Coroner, 34-year old Keith Smith of Clovis and 31-year old Jessica Matthes of Sacramento were the man and woman killed.

Investigators say the two were in a car going westbound on Barstow when it collided with a pickup that was headed north on Minnewawa.  Smith, who was driving the car, died instantly.  His passenger Matthes was taken to the hospital where she later died.

Police want this tragedy to serve as a reminder to take responsibility.  With Christmas around the corner, more holiday parties are being held, which means you will face several opportunities to drink.

"We’re just encouraging people that if you have anything to drink think twice before getting behind the wheel.  Call a friend, stay the night at a friend’s house, call a cab, do anything, but don't get on the streets and drive," said Kristina Hershberger of Clovis Police.

The suspected drunk driver, Larry Garcia, escaped with just minor injuries.  He now faces two charges of vehicular manslaughter.

Investigators are still trying to piece this crash back together, so they have not definitively ruled who was at fault.

SUV driver loses control at wheel on Grapevine

No word if alcohol was a factor in a deadly accident over the Grapevine Sunday morning.

The driver of an SUV drifted off the road, over-corrected, crossed all four lanes of Interstate Five and crashed into a wall. Two passengers were thrown from the vehicle. They were not wearing their seat belts.

A 21-year-old man from Ontario died. Three others are in the hospital, one with major injuries. The CHP continues to investigate the cause of the crash.

Cyber Monday Madness

Monday, many shoppers will escape the loud, hectic mall for the quiet comforts of their computer to strike a deal.

In 2010, Cyber Monday was the biggest online shopping day of the year.  It generated $1 billion.

Discounts, coupon codes, no sales tax and free shipping; the offers are endless.  But you should prepare for possible internet connection slowdowns since more than 120 million people are expected try and take advantage.

Cyber Monday doesn't hurt stores like Horn Photo in Fresno as much as you might think.  Owner Stan Gross says it's because shopping for something like a camera online often turns into an overwhelming task.

"They can't make up their mind.  They come in, they meet us, they handle the cameras, handle the lenses.  They see the experts we have here and see what we can do for them and they usually end up buying from us anyway," said Stan Gross of Horn Photo.

Shiekh, which has two stores at fashion fair mall, believes it can compete.

"We have a whole rack of clothes that's buy one get one free and we're a popular store, so I'm not too worried about it," said cashier Iryl Gomez.

Gomez says something you can never discount is the importance of seeing an item in person.

"It might look good online, but you don't know if it's going to look good on you if you don't try it on and you don't get great customer service," said Gomez.

These are some good online payment tips to follow:

1) Always use a credit card and not a debit card. It gives you more flexibility to dispute a charge without ever having money leave your account.

2) Don't save your card information on a mobile device because if you lose it, someone else will have access to it.

DUI Suspected in Double Fatal Crash

Police are investigating a deadly accident at Barstow & Minnewawa in Clovis.

29-year-old Larry Garcia was allegedly under the influence when he crashed into another vehicle early Sunday morning.

Both people in the other car died in the crash. They have been identified as 34-year-old Keith Smith of Clovis and 31-year-old Jessica Matthes of Sacramento.

The suspected drunk driver had minor injuries and was taken into custody. He now faces DUI and vehicular manslaughter charges.

Man Shot to Death in Reedley

Reedley police are looking for a killer after a man was shot to death over the weekend.

Police say a man in his mid 20's was killed in a shooting early Sunday morning near Manning and Kings River Road. 

The unidentified victim was taken to a hospital, where he later died. 

Investigators don't have any suspects and are asking for anyone with information to call the Reedley Police Department.

Tiger Dies at Fresno Zoo

There is sad news from the Fresno Chaffee Zoo. One of the animals passed away Monday morning. 

Kiri, the Malayan tiger died after recently falling ill. 

Zoo staff and also medical experts from Saint Agnes worked together to try and save her life but were unable to find the source of her illness. 

Kiri came to the Chaffee Zoo back in 2000 from the Cincinnati Zoo. 

She was 11-years-old. 

Money for Children a Priority

Nearly a billion dollars for children won’t be going to Sacramento afterall.  A judge has ruled that it’s illegal for the state to take money out of a fund for children.

The money comes from a fifty-cent tax on tobacco.  Earlier this year state legislators passed a bill that would have taken a billion dollars from that fund; $17 million would have come from Fresno County. 

Four-year-old Justin Moua spends his days in preschool, painting, playing and learning English.  He's one of two dozen children in a nationally accredited program for children of settlement camps.

“Our charge is to get them ready for kindergarten because many of them don't speak English yet,” said Linda Conde, the preschool program director.

But the Fresno International Refugee Ministries wouldn't exist without funding from First 5, which administers money collected in the tobacco tax.  That's why the threat of the state taking their money was devastating.

“It would close this program,” said Conde.

Earlier this year the state legislature voted to take $1 billion dollars from the California Children's Trust Fun..  $17 million would have come from Fresno County and $3 million would have come from Madera and Merced counties.  That is, until First 5 fought back.

“We felt that the courts were our best way to really get a fair ruling on this and level the playing field for our kids,” said Kendra Rogers, Executive Director of First 5 Fresno County.

On Monda, First 5 celebrated a victory.  A judge ruled the assembly bill is illegal.  Rogers feels vindicated.

“Unlike some other government, we don't spend money we don't have.  So because of that planning, really, our kids were victims of raiding,” said Rogers.

Programs who benefit are breathing easier.

“It's a huge sigh of relief because we know that research shows kids who get a preschool experience fare better,” said Conde.

One of AB 99's sponsors, Assemblyman Bob Bluemenfield issued this statement:

"Although this ruling was anticipated, it risks pushing the pain of future budget cuts onto other programs if the votes for revenues remain out of reach."

The state has asked voters twice before to divert First 5 funds and both times, it failed.  The money would have been collected in June of 2012.

Murder, suicide hits close to home

Fresno County is morning the lose of a Fowler high Alumni.
21 year old Ruby grant was killed in a murder suicide this Sunday in Columbus, Georgia.
She moved there and joined the army after graduating high school.
Police say her husband shot her in the head and then himself.
Her coach of 4 years says he can't believe her path away from her hometown of Fowler would lead to this.
"What a tradjic loss. Because this was a very good young lady. Played hard, well respected by her team mates," said Gary Hains, the womans basketball coach
Giana Ramirez grew up playing basketball with ruby who she and others at Fowler High knew by her maden name Ruby Ruiz.
She was captain of the womans varsity basketball team before graduating in 2008.
"I'm sad because I grew up with all them, played basketball since I was 9 years old," said friend Giana Ramires.
Police say for unknown reasons Rubys husband 27 year old Freddie Grant turned the gun on Ruby then on himself.
Columbus police said Monday that both were in the military.
A statement from Fowlers Superintendant reads.
"Her hard work as a student and positive attitude as an athlete were shinning examples of outstanding character for all students."
Local police declined to release further details.

Judge Requests Police Auditor's Report

A judge wants to see the police auditor's report involving an officer involved shooting from 2009.

It’s for a wrongful death lawsuit filed against the Fresno Police Department. 

In court Thursday, the judge requested the report for the 2009 death of Steven Vargas, who was high on PCP when he was shot and killed by Fresno police officers.

A lawyer for the family believes the auditor's report could help his case. 

The family’s attorney, Arturo Gonzalez said, “It could be devastating. I mean, it depends on what it says, obviously. But, you know, our case relies in part on the face that these investigations are not taken seriously, that they take so long, and the officers are not disciplined.”

The judge wants to see the unedited report, written by former Fresno police auditor, Eddie Aubrey. 

The city maintains the officer thought the suspect had a gun and used reasonable force under the circumstances.

Body Found in Burned Car in Fresno County

A body was found inside a burned out Mercedes in an orchard near Fowler and Central.

Emergency dispatch received a call about a burning car around 4:00 a.m. Friday morning.

Fresno County Fire and the California Highway Patrol responded but after finding a body inside the car, they contacted the Fresno County Sheriff's Department. 

Sheriff's investigators don't know how the fire started. They are not releasing details of the vehicle because of the ongoing investigation.

Deputy Chris Curtice said, "We're treating it as a homicide right now. We don't know what we have but its definitely suspicious so we start big and make it smaller. It started as a homicide investigation, if it turns out to be something different, we go from there." 

Fowler, between Central and American remained closed for about 8 hours but has since reopened.

It's unknown if the body belongs to that of a man or a woman. The investigation is ongoing.

A New Morgue For Fresno County

No more maggots, flies or unsanitary conditions, CBS47 got a first look inside Fresno's new high tech morgue.

Fresno County Coroner, Dr. David Hadden says the new morgue is a dream come true. He describes the old morgue as a place that was unfit to work in, filled with maggots, flies and an odor that was unbearable.

"The odor from the decomposing bodies is very very unpleasant kind of a clawing odor that gets into your clothes and stays there," says Dr. Hadden.

But he and his staff no longer have to worry about that in the new facility. Doctor Hadden who helped design the layout says it will boost the morale for his entire staff and because of its state of the art design, it's large enough to accommodate more than 200 bodies and an autopsy room for homicides and decomposed bodies.

"This facility shows the respect that we have for their loved ones who have passed," said Dr. Hadden.

Dr. Hadden says it will also save taxpayers money, the new high tech equipment will help determine the cause of death much quicker than what was available at the old facility.

A dedication of the new morgue will be Monday December 12th at 10:00am.

Dyer Takes Witness Stand in Shooting Death Trial

Fresno Police Chief Jerry Dyer took the witness stand Friday in the trial over a wrongful death lawsuit involving the Fresno Police Department.

The family of Steven Vargas is suing the city for wrongful death and negligence. In court, both sides have agreed that Vargas was high on PCP when Sergeant Mike Palomino shot and killed him in October of 2009.

On the witness stand Friday, Dyer answered questions about his department's policies regarding use of force and how officers are trained. Those policies and training are at the center of the lawsuit filed by Vargas' family.

"We are seeking to prove that the shooting of Steven Vargas was unjustified. And number two, we're seeking to demonstrate and I think we have demonstrated that the police officers of Fresno need more training," said Arturo Gonzalez, the plaintiff's attorney.

On the witness stand, Dyer said officers are taught that they should make attempts to be minimize force, and that firing a gun at someone should always be the officer's last resort.

Gonzalez later questioned why so few officers involved in shootings under Dyer's watch have been disciplined.

"If a police officer does something improper and there's no discipline then I think, you know, that you're not doing your job as a chief. You're not doing your job as the department," said Gonzalez.

Fresno City Manager Mark Scott plans to release a report on Monday that was written by former Fresno Police Auditor Eddie Aubrey. Gonzalez believes it could provide useful information to his case about officer-involved shootings.

Scott says he received the 74-page report in June and felt that it wasn't particularly readableThe report only addresses three completed shooting cases, he said.

"At no time has anyone ever attempted to change the recommendations or findings in the report. And I feel badly that people are wondering if the delay in getting it released was related to that. It has nothing to do with it," said Scott.  

Scott plans to release the report to the public on Monday without any edits.

Dyer resumes his testimony on Tuesday morning.


Driver Rams Fresno Convenience Store

Friday evening at the "Get N Go" market, workers from a glass company repaired the mess that a crook created earlier in the morning.

Surveillance video shows him peering through the window. Then moments later he hops in his Chevy Suburban, revs up and rams the front of it into the store. Not once, but two times. The store’s security cage and a strong support beam prevented the vandal from getting in.

"As soon as I came in I couldn't believe it," said Andy, owner of "Get N Go."

Andy says sadly, this type of behavior is what many convenience store owners have come to accept.

"Some of these people are just so bad. They want money; they'll take beer and run away. If you try to protect, they'll come beat you up," said Andy.

This video from last year, taken in the same store, shows exactly that. Two young guys are seen beating up a clerk after stealing a case of beer.

"For no reason. Nobody stopped them, nobody did anything. These guys are just doing it for fun," said Andy.

The suspects not only got away, they broke the clerk's nose, gave him a $25,000 medical bill and instilled so much fear he never returned to work.

Today's criminals know the jail is overcrowded, so getting released in a matter of hours makes it an easy decision to reoffend.

"People that think like that, they're not right in the head," said Alberto Playo, a customer.

Andy agrees, saying it's enough to make him consider shutting down his stores.

"It’s very frustrating but we're optimistic crime will get better," said Andy.

Andy's insurance will cover the cost of his repairs, but the fact that he has to put in a claim means his premium will go up. This in turn will eventually raise insurance rates for all of us.

Program Helps Mounted Patrol

They are part of the sights and sounds of the holiday season.

This time of year, you’ll see the Mounted Patrol for the Fresno Police Department at shopping malls all around the area.

 

They increase security at a time when criminals are looking for easy victims and items to steal.

Kids love to see and pet the horses. Their parents like having police around.

 

“It gives you a sense of security and safety. You can walk out to your car and you have Fresno police out here,” said Alex Galarza of Fresno.

Money for the Mounted Patrol was cut from the city budget. They rely now on donations to stay in hay and horse shoes.

 

This year, officers with the Mounted Patrol are handing out SHARES cards that can be used at Save Mart Grocery Stores. Just let the checker know you have the card and they will scan it. And a portion of the bill goes to the Mounted Patrol.

“With Save Mart giving us back three percent, it helps keep our horses fed and the shoes and such on them,” said Officer Ed Slaton with Fresno Police.

 

It costs about 40-thousand dollars a year to feed the horses, keep a roof over their head, and make sure they’re healthy.

The officers on horseback fight crime. They helped catch a car thief near Fashion Fair mall two years ago. And from high up on a horse, they can see things other officers can’t.

 

“We're up higher.  We can see people in the parking lots that you can't see otherwise, so it's just an advantage” Slaton said.

Taneha Martin of Fresno picked up a SHARES card and plans to use it.

 

“We lost the Clovis horses due to not having money, so I think it’s a good thing,” Martin said.

You can get a SHARES card from any Mounted Patrol officer. During the Christmas season they patrol River Park, Fashion Fair, Manchester Center and Fig Garden Village in Fresno.

Shooting in Merced

Man shot in Merced dies.

Merced Police were called to the 1000 Blk. of Loughborough Drive and found an adult male who had sustained gunshot wounds.

The victim told officers that a white four door vehicle was involved in the incident. The victim was taken to a Merced Area Hospital where he died from his injuries.

Police detectives are following up on leads but are unsure at the present time if this incident is gang related.

Gang Members arrested with guns

Three gang members are taken off the streets in Merced.

Friday officers arrived at an apartment on the 3100 block of
Meadow Avenue
and found three men inside the apartment. After interviewing Souphilavong Xayarath, he admitted to possessing a 9mm handgun. Officers also spoke with Phonephilom Phrasavth and Danny Souphilavong who were also inside the apartment. A search of the apartment resulted in finding a Tech 9 submachine gun.

All three of men are documented gang members and/or associates. All three were arrested and booked into the Merced County Sheriff’s Department Correctional Facility.       

    

Visalia Police Shoot and Kill Suspected Shoplifter

An investigation is underway after a Visalia Police officer shoots and kills a suspected shoplifter at Sequoia Mall. Police say the 29-year old man lunged at the officer with a knife, which forced him to fire his weapon at the armed man. What's interesting is the suspect was actually in a wheelchair during most of the incident.

It happened around 4:30 pm Saturday while the mall was busy with holiday shoppers. Police say the man had wheeled his way outside of Sears when security guards approached him for trying to steal merchandise. The suspect then pulled a knife on the guards, then quickly scooted away through the parking lot.

Visalia Police were called in to search for him. Officers spotted him going inside nearby Marshalls. He used a back door to try and escape and that's where he was confronted by an officer. The suspect reportedly stood up out of his chair and lunged at the officer with his knife. The two men got into a struggle, then fearing for his life, the cop shot the suspect. He was taken to Kaweah Delta Medical Center where he later died. The officer received some minor injuries, but is ok.

Police say they are familiar with this suspect. He's been arrested before, but police would not elaborate on his criminal history. Investigators did recover the suspect's knife. However, it's unclear if he had any stolen merchandise on him.

The Tulare County Sheriff's Department is also now involved with investigating this case.
